1. Acceptance of Terms
Welcome to Arbor & Co. By accessing our website at arborandcoo.info or using our watch repair services, you agree to be bound by these Terms and Conditions ("Terms"). If you do not agree to these Terms, please do not use our website or services.
These Terms constitute a legally binding agreement between you ("Client," "you," or "your") and Arbor & Co ("we," "us," or "our").
2. Definitions
For purposes of these Terms:
- "Service" refers to watch repair, inspection, restoration, and related services provided by Arbor & Co
- "Timepiece" refers to any watch or clock brought to us for service
- "Agreement" refers to the written service estimate provided before work commences
- "Website" refers to arborandcoo.info and all associated pages
3. Eligibility
You must be at least 18 years old to enter into this agreement and use our services. By using our services, you represent and warrant that you meet this age requirement and have the legal capacity to enter into binding contracts.
4. Service Description
4.1 Services Offered
Arbor & Co provides professional watch repair services including:
- Gear Train Inspection
- Complete Train and Escapement Service
- Thoroughbred Restoration
- Additional specialized services as agreed upon
4.2 Service Scope
All services are performed based on a written estimate provided after initial examination of your timepiece. The scope of work, timeline, and cost will be clearly outlined in the service agreement.
4.3 Service Availability
Services are provided at our workshop location in Kaohsiung, Taiwan. We reserve the right to decline service requests if we determine we cannot adequately serve the timepiece or if the request is unreasonable.
5. Client Responsibilities
5.1 Accurate Information
You agree to provide accurate and complete information about your timepiece, including any known issues, previous repairs, and service history.
5.2 Ownership Verification
You represent and warrant that you are the rightful owner of any timepiece submitted for service or have authorization from the owner to seek repair services.
5.3 Service Agreement Review
You are responsible for reviewing and understanding the service agreement, including scope of work, timeline, and costs, before authorizing service to proceed.
5.4 Timely Collection
You agree to collect your timepiece within 30 days of notification that service is complete. Timepieces not collected within 90 days may be subject to storage fees or disposal in accordance with Taiwan law.
6. Payment Terms
6.1 Pricing
Service prices are provided in New Taiwan Dollars (NT$) and are based on the scope of work outlined in the service agreement. Prices include labor and standard materials but may exclude specialized parts that must be sourced.
6.2 Payment Methods
We accept payment via cash, bank transfer, or other methods as agreed. Full payment is required before the timepiece is released to you.
6.3 Additional Work
If additional issues are discovered during service that were not identified in the initial inspection, we will contact you with a revised estimate before proceeding. You are not obligated to authorize additional work beyond the original agreement.
6.4 Cancellation
If you cancel service before work has commenced, no fee will be charged beyond any diagnostic inspection fee already agreed upon. If work has begun, you will be responsible for labor and materials used up to the point of cancellation.
7. Service Timeline
Timeline estimates provided are approximate and based on typical service requirements. Actual completion time may vary due to:
- Discovery of additional issues during service
- Availability of replacement parts
- Complexity of the timepiece
- Our current service queue
We will notify you of any significant delays beyond the estimated completion date.
8. Warranty and Disclaimers
8.1 Service Warranty
We warrant that services performed will be executed with professional skill and care. If issues directly related to our service work arise within 90 days of completion, we will address them at no additional charge.
8.2 Warranty Exclusions
The warranty does not cover:
- Issues arising from misuse, accident, or normal wear after service
- Problems related to parts or components not serviced by us
- Damage from unauthorized repairs or adjustments
- Water damage if water resistance was not part of the service agreement
8.3 No Guarantees of Specific Results
While we perform services with skill and care, we cannot guarantee that your timepiece will achieve specific performance metrics or appearance standards beyond what is outlined in the service agreement. Vintage timepieces in particular may have inherent limitations that cannot be fully overcome.
8.4 Service "As Is"
Except as expressly stated in the service agreement, services are provided "as is" without warranties of any kind, either express or implied.
9. Limitation of Liability
9.1 Liability Cap
Our total liability for any claims related to services provided shall not exceed the amount you paid for the specific service giving rise to the claim.
9.2 Exclusion of Consequential Damages
We shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or use, whether in an action in contract, tort, or otherwise, even if advised of the possibility of such damages.
9.3 Force Majeure
We shall not be liable for any failure or delay in performance due to circumstances beyond our reasonable control, including natural disasters, war, terrorism, labor disputes, or governmental actions.
10. Indemnification
You agree to indemnify and hold harmless Arbor & Co, its owners, employees, and agents from any claims, damages, liabilities, and expenses arising from your breach of these Terms or your use of our services in violation of applicable law.
11. Intellectual Property
All content on our website, including text, graphics, logos, images, and service documentation, is the property of Arbor & Co and is protected by Taiwan and international copyright laws. You may not use, reproduce, or distribute any content without our written permission.
Photographic documentation provided as part of restoration services remains our property but may be used by you for personal reference.
12. Dispute Resolution
12.1 Informal Resolution
In the event of any dispute, claim, or controversy arising from these Terms or our services, you agree to first contact us at [email protected] to attempt to resolve the matter informally.
12.2 Governing Law
These Terms shall be governed by and construed in accordance with the laws of Taiwan, without regard to its conflict of law provisions.
12.3 Jurisdiction
Any legal action or proceeding arising under these Terms shall be brought exclusively in the courts of Kaohsiung, Taiwan, and you consent to the personal jurisdiction of such courts.
13. General Provisions
13.1 Entire Agreement
These Terms, together with any written service agreement, constitute the entire agreement between you and Arbor & Co regarding our services and supersede all prior agreements and understandings.
13.2 Severability
If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions shall continue in full force and effect.
13.3 Waiver
Our failure to enforce any right or provision of these Terms shall not constitute a waiver of such right or provision.
13.4 Assignment
You may not assign or transfer your rights or obligations under these Terms without our written consent. We may assign our rights and obligations without restriction.
14. Changes to Terms
We reserve the right to modify these Terms at any time. Changes will be effective when posted on our website with a new "Last Updated" date. Your continued use of our services after changes are posted constitutes acceptance of the modified Terms.
Material changes that significantly affect your rights will be communicated via email if you have provided contact information.
